AIE requests made to the Office will be dealt with by the Secretariat.
The Ombudsman holds the offices of both the Commissioner for Environmental Information and the Protected Disclosures Commissioner. While certain ‘in house’ services or facilities are shared between both offices, each office has separate staff who are designated to carry out their functions in an independent manner. When making a request for information under the AIE Regulations you are required to:
Normally you will be notified of the decision on your request within 1 month of its receipt.
If you consider that your original request for environmental information was refused wholly or partially, or was otherwise not properly dealt with in accordance with the provisions of the AIE Regulations, you may request that the Office carry out an internal review of the decision. This request must be made not later than one month from the date that you receive the decision from the Office. The review will be carried out by a member of staff who is not connected with the original decision, and who is of the same grade as, or more senior than, the original decision-maker.
No fee will be charged for the internal review process.
A written outcome of the review informing you of the decision, the reason for the decision and advising you of your right of appeal to the Commissioner for Environmental Information, including the time limits and fees associated with such an appeal, will be issued to you within one month of the date of receipt of the request.
There is no initial fee required when making an AIE request to this Office. The Office may however, charge a reasonable fee for supplying environmental information in accordance with the Regulations. The Office has set an indicative fee as follows:
Details of charges, if any, will be advised in the decision letter. The Office will take account of your personal circumstances when calculating any fees that might apply.
